Mediation communications are privileged under Ohio law set out in the Uniform Mediation Act, Ohio Revised Code 2710.01 and following sections. If the case is pending in a court, a mediator has a VERY strictly limited amount of information that can be communicated to the court. Under the Uniform Mediation Act, the parties can also enter into a confidentiality agreement, something that is not available in a public court room setting.
